1. Agreement to Terms

By accessing or using our website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Services

ATRCreate provides web design, development, and related digital services. The specific scope, deliverables, timeline, and pricing for each project will be outlined in a separate Statement of Work (SOW) or proposal agreed upon by both parties before work commences.

3. Payment Terms

Unless otherwise specified in the project agreement:

50% deposit is required before project commencement
25% is due upon design approval
Final 25% is due upon project completion/launch
Invoices are due within 14 days of issuance

4. Intellectual Property

Upon full payment, the client receives full ownership rights to the custom work created specifically for their project. This includes designs, code, and other deliverables outlined in the project scope.

ATRCreate retains the right to display and link to completed work as part of our portfolio and promotional materials, unless otherwise agreed in writing.

5. Client Responsibilities

Clients are responsible for:

Providing necessary content, assets, and information in a timely manner
Providing feedback within agreed-upon timeframes
Ensuring they have rights to use provided content and materials
Maintaining backups of their own data and content

6. Revisions and Changes

The number of revision rounds included will be specified in the project proposal. Additional revisions or changes to the project scope may incur additional fees. Significant scope changes will require a revised proposal and timeline.

7. Limitation of Liability

ATRCreate shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use our services. Our total liability shall not exceed the amount paid for the services in question.

8. Termination

Either party may terminate a project with 14 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. Deposits are non-refundable unless otherwise agreed in writing.

9. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after any modifications indicates your acceptance of the updated terms.
